Pioneer Nevada / Jinlun Texan: A Diary — Marshy’s Motorcycles?

Don’t get me wrong, I love my Huoniao, but I wanted to do it again, I wanted to get a cheap Chinese bike in a crate and go through all the ups and Downs it entails. This will be a complete diary from order to delivery to completion, every aspect will be covered in as much detail as possible.

The Beginning:

About a month ago I went to a local motorcycle dealers that specialise in Chinese bikes, I was getting new tyres on my beloved Huoniao because I was tired of risking my life each time I took it out in the rain.

I pulled up outside the dealers and there she was (be still my beating heart!) the most beautiful masterpiece you have ever seen, The Pioneer Nevada. I was in love, I even considered trading in the Huoniao against it, It was big, black, lots of chrome and just looked so good, I couldn’t believe it was a 125cc! I decided there and then I wanted one, now it wasn’t cheap £1399 (which I found out later is a bit much) so I had to hold off for a bit till I scavenged the money together.

I went home that day, Googled it and started to do my homework.

The first site that popped up was the Pioneer Nevada Owners Club , I don’t know who created this forum but BRAVO! its amazing, the amount of information contained in this website is unreal, it covers everything from buying to building to modding your Nevada. I cant praise this website and all its members enough, it is truly a labour of love and if you own or are considering owning a Nevada, join this forum. I spent weeks reading the forums and topic’s over and over again until I finally managed to gather the money needed for my bike.

I had £1400, I knew from the Pioneer Nevada Owners Club (PNOC) that I would be paying over the odd’s for my bike but I didn’t care I wanted to be on it A.S.A.P. I didn’t want to bother building it or waiting to tax it or waiting for delivery, I wanted to part with my cash and drive off into the sunset with it that same day. I was off work on Saturday so I would have to wait till then. Friday night was a nightmare, It was like I was 8yrs old on Christmas Eve, I was so excited I couldn’t sleep!

Saturday 20th September 2008:

First thing this morning I went to the bank to withdraw the £1400 in cash with the hope that I can bargain them down from the original price with the incentive of a cash payment, 30min’s later I was at the dealership with a great big grin on my face, this soon turned to a grimace of dismay! They had none In stock!!!! How could this be???? they had 4 in stock when I was there about a month ago!! I was Pissed! “we can order one in” said the helpful dealer but I was heartbroken and didn’t want to know. I went to 6 other dealers that Saturday hoping against the odd’s that I would find one that had a Nevada in stock but unfortunately it was to no avail.

Sunday 21st Sept 08:

I decided today that I would do what I did with the Huoniao and buy a Nevada in crate form and do it up myself, I scoured the net, Ebay and the PNOC trying to find the best deal. I emailed a couple of sellers for their best price and then for some god unknown reason I decided I would buy 2 Nevada’s instead of one.Let me explain: Like most men, when it comes to big boys toys I have that unreasonable primitive Neanderthal man brain, where something that doesn’t make a lick of sense to the female species makes perfectly obvious sense to me and any man aged between 12-72yrs old e.g. Why buy one when you can buy two at twice the price. So I got it in my head to buy two and nothing or nobody would change my mind. I made some more email enquires and waited for responses.

Monday 22nd Sept 08:

I woke up and went to work this morning to find my inbox overflowing with offer’s (not!). Now people must understand the way I think before I tell you who I have bought from.

I believe that most people are genuinely good people, they don’t set off from home each day wondering who’s day they can fuck up today or who’s life they can make a little more miserable, I honestly think people try to be good. I know sometimes I’m not good (an evil bastard at times) but I also know that I Try to be good and that’s what counts.

As I said previously I had done me homework via PNOC and a certain company Marshy’s Motorcycles has a pretty bad name and reputation amongst the members of the forum but I decided to give Marshy’s the benefit of the doubt and help them redeem their name (by not fucking with me) so I phoned them up had a chat with a very pleasent chap (who’s name escapes me, sorry) and did a deal to have 2 Nevada’s, one black and one blue (at this chap’s suggestion) delivered to my door for the price of £1900 (£950 per bike inc delivery). I know alot of people are cursing me right now saying I could have got it cheaper but I didnt care for a couple of reasons. 1) I was going to pay £1400 for 1 bike anyway so the second bike has only cost me £500. 2) I like to give people a chance as I did with LS Imports when I bought the Huoniao and they did me proud, now its Marshy’s Motorcycles turn to do me proud.

Marshy’s told me it will be about four weeks before they’re delivered which I was a bit upset about but it is understandable but when someone says to me about 4 wks I expect to have it within 3.5 wks and not 4.5 or 5.5wks (Pay attention Marshy!!) so hopefully If all goes well and no one fucks around my next post here should be before or on the 20th October 2008 when my bike’s arrive.

Update: Wednesday 1st Oct 08:

Today my situation has changed, for the better or worse is yet to be decided.

I received a phone call this morning from Rachael of Marshy’s Motorcycles.

she was very pleasant and she informed me that unfortunately due to their suppliers letting them down they would be unable to supply me the 2 Pioneer’s but in lieu of them she offered me 2 Jinlun Texan’s (which normally cost more) at the same price and delivery within 14 days (which is a big bonus), so I agreed to her proposel and now I will start my homework once again but this time on the Jinlun Texan.

So thumbs up to Marshy’s for keeping me informed on the progess of my order. As a paying customer being kept informed of anything that affects me or my goods is a number one concern and Marshy’s have rose to the occasion! Fair play to yeh!

Thursday 9th Oct 08:

In preparation for my new arrivals I have stocked up on a few bits and pieces and due to my ever-disappearing tools (borrowed but not returned!) I have had to invest in some new ones as well.

2 x 10ml bottles of 243 Threadlock from StarLoc Adhesives Ebay shop for £3.99 each.

2 x 600ml WD40 from my local Halfords at £3.99 each.

1 x 500g tub of Multi Purpose Grease (Halfords) at £5.49

2 x 400ml 3-In-One Professional White Lithium Grease also from the Local Halfords at £4.99 each and from ScrewFix Direct I bought a reversible 1/2″ Torque Wrench a 40pc Socket set(1/4″ & 3/8″) and a 26pc (cheap) toolkit which comes in a bag with an assortment of tools, all for £63.97 delivered.

So now that Im prepared I just have to wait for Marshys to get their finger out and deliver my bikes, according to my last phone call from them my bikes should arrive no later than Tuesday :-).

Friday 10th Oct 08:

Today I have become a bit concerned, A letter arrived in the post from Marshys with some documents (Invoice, Warranty book, etc), The Invoice shows 2 Pioneer Nevada’s which is understandable because that is what I paid for on the 22nd of September, What concerns me Is the letter is post marked 08th Oct which is a full 7days after they had phoned to say they could not supply the Nevada’s. Now I dont know if this was an admin error or not but considering my bikes are due on Tuesday it gives me grounds for concern.

Ok, I have calmed down enough to fill you in on the details, Before I start I don’t want any “I told you so” comments 🙂

My bikes should have arrived on Tuesday the 14th but low and behold they did not, I phoned Marshy’s Motorcycles about 16:00hrs to be informed there was no one in the office and could I ring after 12:00hrs the next day.

I phoned at 12:01hrs on the Wednesday only to get a voice message saying that they would be unavailable all day. I am not a happy camper!

On Thursday the 16th when I phoned the gentleman took my details so he could find out what was happening, He rang me back with in 10mins and informed me that my bikes were on a boat from China and it would take 4-6 weeks before I got them! 4 to 6 fucking weeks more!

I politely explained my situation and what had happened re: the changing of the bikes and the 14days delivery, I ensured him he must be wrong and there was a mistake somewhere along the line because why would someone from his company ring me to tell me they had bikes in stock and I would have them in 14days when they actually meant to say “sorry Mr X we have got your money so we dont give a fuck about you and you will get your bikes when we are bored pissing you about”!

Needless to say I was pissed! the original 4 weeks delivery has now turned into 10 weeks thats 2 1/2 months delivery!!!!!

He then explained the fault fell with the manufacturers as they didnt make them fast enough to keep up with the demand in the UK. BOLLOX!

With steam coming out my ears and without the possibility of reaching down the phone to rip his throat out I decided not to pursue my futile argument in fear that i would end up getting some sort of halfwitted response of “Aliens abducted the first shipment of bikes, Its not our fault”

I asked him about canceling the order and getting a refund and guess what! It would take 2 Months to refund my money, 2 Fucking Months, It only took them 30 seconds to take my money but it would take 2months to refund me. When I asked why so long he told me that all the companys money was tied up in this shipment.

Instead of arguing with him I just said “leave it with me” and hung up the phone. Tosser’s!

Now normally I am a nice passive gentleman and since I wanted my bikes so much I would normally just bend over and let Marshy’s give it to me up the arse and wait the 4 – 6wks (This would undoubtedly change to 4 – 6 months) for my bikes rather than wait the 2 months for my refund, But not today!

I got on to Consumer Direct from the Office of Fair Trading (Trading Standards) I explained the whole situation, I gave them Marshys address and details and told them everything they had said. They gave me a reference number and told me to send a letter Recorded Delivery to Marshys and to contact them again if Marshys have not satisfactorily responded within 7 days. I was out of the country for the last week as I had coincided my holidays with the arrival of my bikes so I could set them up without the stress and strain of work so as now my bikes were not coming on the arranged date I decided to go on a holiday to relax.

On Saturday the 25th of October 2008 at 09:29hrs I sent the following letter recorded delivery to Marshy’s Motorcycles

Dear Marshys Motorcycles,

I am writing to you regarding the 2 x Pioneer Nevadas from you on 22/09/2008

At the time it was agreed as part of the order that the 2 x Pioneer Nevadas should be delivered to me by 22/10/2008.

On the 01/10/2008 Racheal from your company contacted me by phone and explained that your company could not supply the 2 x Pioneer Nevadas ordered by myself and in lieu offered me 2 x Jinlun Texans, I was a bit reluctant but I agreed when she said the delivery will be within 14days which would be at latest the 15/10/2008.

The goods still have not arrived and I understand that under The Distance Selling Regulations 2000 you are obliged to deliver the goods within the agreed time, or at least 30 days after you received my order.

As you have not sent me the goods, I am entitled to cancel the order and I should be refunded for the full amount. This refund should be sent within 7 days of me cancelling the order.

Therefore, I would request that you write to me to confirm whether you can send me the goods or not. If you are unable to send me the goods then you should issue me with a full refund within 7 days of your written confirmation.

I look forward to hearing from you.

Now I have put the whole letter above (minus details) so anyone in the same or similar circumstance’s can just copy it, sign it and post it.

All I can do now is play the waiting game and see what happens, I will update this blog as it happens and please feel free to comment and give any advice you can as this may help prevent other poor sod’s being caught and hoodwinked by the Consumers Nightmare that are Marshy’s Motorcycles.

The worst thing about the whole situation and what piss’s me off most is that they lied to me, If they had of told me in the first place that they could not get the bikes for 10wks I may have been prepared to wait!!

Take heed Marshys! your customers are your bread & butter! be honest with them, It will work out better for your reputation!

Tuesday 28th Oct 08:

Update: I don’t know if it was the power of the blog, my letter or just an innocent mistake but I got a phonecall today from Racheal at Marshy’s to tell me my bike’s were being dispatched for delivery on Friday (31st Oct), I told her about the letter (which she explained she had received and was replying to) and the reason behind it, She was as confused as I was because my bikes were in stock and not 4-6wks away.

It seems that the reason for the confusion was down to my original order of the Nevada’s (which are 4-6wks away) which I presume my name was still attached too so when I enquired on Thursday 16th the gentleman must of assumed I was refering to the Nevada’s and not the Jinlun’s hence his response.

So if this is the case, Marshy’s I sincerly apologise for my comments earlier in the month (which I must add was not directed at any 1 individual, but at Marshy’s as a whole!)  and look forward to delivery on Friday (even though its 2wks later than arranged!)

This blog has now reverted back to its original title pending the outcome.

Update: In the post this morning was the following letter from Marshy’s Dated 28/10/2008.

Dear Mr Redpox1st(not my real name!)

Thank you for your letter dated the 22/10/2008. We are writing today to confirm delivery of both these motorcycles that were ordered on the 22/09/2008.

First of all, may we apologise for the delay you have experienced with our company.

We have also experienced disappointment from our supplier’s not meeting delivery dates.

However, both of the bikes are being delivered on Friday 31st October.

The delivery driver pulled up shortly after 10am and I gave him a hand to take them from the truck, This was not an easy thing to do as the box’s were much bigger and heavier than anticipatied

  1. it’s a shame MM let you down mate, but to be honest with ya, it’s just what they do. if you have your heart set on the nev call lia imports, if anyon ecan sort you out with not only a great service bit a great bike it’s them.
    but if you stick with the jinny’s then your gonna love them to.
    we at the PNOC are glad we could help out with your research and hope we can still be of some use to you with your new jinny, they are after all very similer bikes.

  5. Thanks for the information. I’m glad you got your order in the end. I am at step 2 i.e. they are still lying to me, the bike was ordered on the 5th septemeber and should have been delivere3d today following pathetic excuse after excuse. I wish I hadn’t bothered, I believe they are crooks and hope they prove me wrong but I doubt it.

  6. What Bike is it John? Thats way to long! You should send that letter above I guarantee they will get back to you with some info! and if worse comes to worse there are companys that have these bike’s in stock! keep me up to date with how you get on.

  7. Hi, the bike is a sanya 125. I have real concerns now as they are not returning my calls and hang up when I ask when the bike will be delivered. My wife did get through using a friends mobile, and they duly rang back (probably expecting a sale), she said if she didn’t receive the bike within 7 days that we will take legal action, they just said “we’ll wait for the letter” I have contacted consumer direct and I’m in the process of sending the letter above, thanks for the advice. The worrying thing is that they are still accepting orders for this model and others, as one of my team at work phoned to try and buy one as a test. My strong advice is DO NOT ENTER into any agreement with this company until you can be absolutely sure they are financially sound.

    Dear Marshy’s Motorcycles,

    I am writing to you regarding the Sanya 125cc motorcycle ordered from you on 6th September 2008.

    At the time it was agreed that the motorcycle would be delivered to me within 28 days of order placement. On several occasions over the last 12 weeks, we have contacted your company to arrange delivery, and have been given numerous reasons for non delivery, ranging from the bike is not in stock to the driver has gone home sick.

    The goods have still not arrived and your representative on Tuesday evening had no knowledge of when the order would be fulfilled, and terminated the telephone call when I expressed my dismay.

    Following consultation with my solicitor, consumer direct (ref 513331) and trading standards, I understand that you have a statutory duty to supply and deliver the goods within the agreed time, or at least 30 days after you received my order.

    As you have not sent me the goods, I am entitled to cancel the order and request refund of the full amount, including the delivery charge at the rate of VAT at the time of order placement i.e. 17.5%.

    I believe that I have been very reasonable throughout the process but have been given little alternative and wish to cancel the order without further delay.

    This letter is confirmation of cancellation of the above order.

    I formally request a full refund of £900, this amount must be sent within 7 days of receipt of this letter (sent recorded delivery) Please note, a copy of this letter has been lodged with trading standards and my solicitor.

  9. Wow! that’s even better than mine!
    They have to respond in writing to you so yes I do think this letter will do the job, what I will say is you now have to decide If you actually want the bike or not, because when they contact you they will probably say it will be with you by the end of the week (or some shit) I will leave it up to you to decide but make sure they dont bully you into doing something you dont want to!

  10. I am not giving them the sale, I am prepared to spend double rather than buy from them. I will be actively joining every review site I can find and warning people over the next few days, I have also been discussing the case with trading standards with a view to fraud as they are still accepting orders.

  13. Finally got a refund via VISA, just received a letter this morning from an insolvency firm, asking for details as Marshy’s are going into a voluntary arrangement under Part VIII of the 1986 insolvency Act.

    Looks like I came out of it okay, I hope there are not too many affected, however they were accepting orders up to Christmas Eve.

  14. Its good to hear that at least you got your money back!!
    I suggest anyone waiting for a bike (or anything else for that matter!) from Marshys gets their finger out and starts trying to get their money back!
    Remember If a company is liquadated the creditors will get their share first so you could be waiting a very long time to get your money back, and that’s only if there is money left!!!
    The moral of the story: Dont take stupid chance’s like I did, do your research and most importantly make sure you can get to the actual shop or address where you send your money! that way if the shit hit’s the fan you can always pay them a visit in person and burn the place down!!!!

  15. Hello. I bought a Nevada Cruiser in July 2008 and finally got it in September 2008 after much hassle. When the bike arrived it was too large, heavy for me, the paintwork was different from the picture i ordered, and the panniers i had been promised were missing. A week into riding the bike the gear stick dropped off mid ride!!!! Then the handling and sound altered and more nuts and bolts come loose. Couldnt get a peep from Marshys. So wrote to my Mastercard to reverse the payment. Meanwhile recieved a letter from the Insolvency Firm also asking about my transaction. So ive written to the bank again enclosing this letter and hopefully i will hear back soon. Meanwhile im stuck with the bike and paying the credit card…..

  16. Pack of bastards, They are supposed to do a PDI on it before they send but ive been told that they are lethal at it and send out death-traps!! The item you where sent is different to the item you bought so you should be entitled to a refund!
    Is the bike still functional? If you want I may be able to talk you through putting it back together.

  17. When the handling and sound altered the bike shot out toone side and threw me into the road inuring my shoulder and thigh, I managed to get the bike home driving slowly. At first i thought maybe id revved to hard or slipped on ice, but weeks later i tried to move the bike again just driving across the lawn and it did the same thing slid to one side throwing me off.. so thats when I contacted Marhsys.. I didnt dare ride it again even to take it to a garage, im a beginner and just didnt want to risk it.. Marshys never got back, so I wrote to the bank thinking if i get the payment reversed then Marshys will soon get their finger out, but thats when I got the letter from the Insolvency Firm. I sent a copy of this letter to my bank, as they were waiting to hear from Marhsys, and I heard back today they are temporarily removing the aount from my card, but they want me to take the bike to a reputable company and get a list of all faults and repairs needed on a letterheaded paper.. But i dont want the bloody thing repairing I wanted Marhsys to take it back and just refund me, as the bike is not suitable…

  18. Can anyone suggest a lightweight motorbike that would be suitable for myself??? The Pioneer Cruiser was extremely heavy and large and being female and only 5’3 i need something i can wheel without it falling onto its side.

Hi Kelly As a point you didn’t get what you ordered “a fully working bike” so you are entitled to request a full refund and I presume you bought it over the phone or off the net that way your covered by the “Consumer Protection (Distance Selling) Regulations 2000″(check out this website http://www.creationinternet.co.uk/distance_selling_act_info.htm)
    Regarding a smaller bike the Huoniao HN125-8 is a great bike that I have had no problem with at all, it probably weighs half of what a Texan or Nevada would weigh (check out my Huoniao Blog: https://redpox1st.wordpress.com/2008/08/25/the-huoniao-hn125-8-haotian-vixen-value-for-money/).

Thanks for the info, I wrote to the bank again saying requesting me to get a status report was not good enough, I said that i’d wrote to Marshys when the bike arrived telling them of the differences and problems and requested a return and refund under the Distance of Selling Act, I enclosed copies of letters. I also played on the fact that the bike isnt even registered to me, as Marshys sent me registration papers for a Blue Sanben Bike instead of the Nevada I bought. So how can they prove I have the Nevada they want me to pay for??? I’ve decided to buy a new 125cc Tamoretti Scooter, as i think its going to be much easier for me to handle, and i only want it for getting to work, but I cant afford to buy it until I get the refund, so right now I’m at the mercy of the credit card company.

  21. Kelly, Marshy’s have gone bust, there are articles all over the net, and I have set up a website to help people who have been conned. Your story is typical of the horrors that are surfacing. Good luck in getting your cash back, when they catch up with these people they want lynching.

  22. Thanks John, yes I know as I received a letter from Fox Managment. I recieved another letter from my banks today,still not backing down they have arranged for a local garage to come take a look at it and do a report, but Im so frustrated, I dont know what this will achieve. I want the bike taking away and a refund, what will a report by a Garage do?? The Bank totally ignored all my points about the distance selling act etc..I feel maybe i should give up and just sell the bloody thing….anybody want to by a Pioneer Nevada Cruiser….:-(

    Anyone stung by Marshys should check out Johns site http://marshysconnedme.com/ and a word of warning to the uninitiated, stay away from ESR Motorcyles (Ebay) they ARE who you think they are!!!!

  24. Had the report on the Nevada today, he found the exhaust was loose, the chain was very loose, the 2 footpedals were both loose, the allignment was out by a mile. He recomended I dont ride it again. So he is sending his report to the bank, surely they will have to refund me now!! I am wanting to buy a Scooter now and have found Scooter Central who have their own website as well as trading on Ebay, they state Jamie Oliver among their clients..anybody know if I can trust them or not, Im thinking of buying one of their Tamoretti 125cc Scooters.

  25. Kelly, I have no idea but I wouldn’t dream of buying a bike that way again. If you pop over to my website above there are a couple of dealers on there that are genuine that would be able to give good advice.

  29. First off sorry that you had a huge problem with Marshys. I know from experience and being co-owner of the site that it was a bad decision.. as I stated from my own personal experiance. Marshys didnt have issues with there supplier .. well not in the way the made it out.. they were banned from selling nevadas because of the way they did buisness with there customers. Then they went into administration as you probably know. many have lost there money! the PNOC will happily help everyone with any bike.. we are not just here for nevadas.. but also jinluns.. etc… so please join up free of charge and ask away.. we are all here to help.. although we also want to encourage more nevada owners to join…

I also purchased a pioneeer from this company I never received it they bullshited me just like everyone else I got my money back 12 weeks later after a strugle they tried to farm me of witha bike more expesive from lIAM IMPORTTS i politly refused and asked for my money back go to Alpha Custom Bikes they are brilliant and deliver bang on time he is a getleman business man
